Can a lawyer help avoid or reduce a driving ban?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The short answer: <strong>yes<\/strong>, but it depends on the facts, your record and legal strategy. In this article, Novex Advocaten explains how to avoid, limit or delay a driving ban.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">When is a driving ban mandatory?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Not every driving ban is unavoidable. Belgian road traffic law distinguishes two types:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Optional driving ban:<\/strong> the judge decides freely whether to impose a driving ban. This is the case for a first speeding violation of the second or third degree, or for an alcohol intoxication just above the thresholds. Suspended driving ban<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Bij een eerste overtreding kan de rechtbank het rijverbod met uitstel opleggen. Dat betekent: het rijverbod wordt uitgesproken maar u hoeft het niet uit te voeren, zolang u binnen een bepaalde termijn geen nieuwe overtreding begaat. Dit is een re\u00ebel en frequent gevraagd alternatief \u2014 maar u moet er uitdrukkelijk om vragen en dit juridisch onderbouwen.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Limited driving ban for professional use<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Als u beroepsmatig afhankelijk bent van uw rijbewijs (bv. zaakvoerder, vertegenwoordiger, zorgverlener), kan de rechtbank een beperkt rijverbod uitspreken: u mag enkel rijden voor professionele doeleinden, op bepaalde dagen of uren. Dit vereist een concrete onderbouwing van uw beroepssituatie \u2014 een taak waarbij een advocaat cruciaal is.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Contestation of evidence.<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A driving ban presupposes a proven offence. If the evidence is debatable - an uncalibrated radar, a procedural flaw in the breath analysis, an invalid PV - acquittal or nullity of the prosecution can be obtained. Then no driving ban is possible.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4. Mitigating circumstances<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A clean criminal record, remorse, willingness to rehabilitate, an emergency situation or medical circumstance - all these elements can convince the judge to waive or minimise a driving ban.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What if the driving ban has already been issued?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Is there already a judgment? If so, there are still options:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Appeal<\/strong> at the correctional court: you can challenge the verdict and ask for a more lenient sentence. The appeal suspends the execution of the driving ban.<\/li><li><strong>Resistance<\/strong> if you were in default: if you were not present at the hearing and a judgment was rendered in default, you can file an opposition.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Practical advice: consult a lawyer as soon as possible<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">De kans om een rijverbod te vermijden of te beperken is het grootst v\u00f3\u00f3r de zitting.
