Debt collection: what are your options as a creditor?

When a debtor fails to pay, as a creditor you have legal means to enforce your rights. Novex Lawyers assists companies and individuals with debt collection in Belgium.

Step 1: notice of default

The first step is a formal notice of default by registered letter. In it, you summon the debtor to pay within a certain period of time, mentioning the legal interest and possible legal action in case of non-payment.

Step 2: subpoena to court

If payment is not made, you summon the debtor to the competent court (justice of the peace, company court or court of first instance). After a guilty verdict, you can proceed to enforcement through a bailiff.

Seizure of wages or bank account

With an enforceable title, the bailiff can seize the debtor's wages or bank account. Novex Lawyers will guide you through this process from A to Z.
