Debt collection: what are your options as a creditor?

When a debtor fails to pay, as a creditor you have legal means to enforce your rights. Novex Advocaten assists companies and individuals with debt collection in Belgium.

Step 1: notice of default

The first step is a formal notice of default by registered letter. In it, you summon the debtor to pay within a certain period of time, mentioning the legal interest and possible legal action in case of non-payment.

Step 2: summons before the court

If payment is not made, you summon the debtor to the competent court (justice of the peace, Enterprise Court or court of first instance). Once judgment has been obtained, you can proceed to enforcement through a bailiff.

Seizure of wages or bank account
