A speeding ticket in Belgium can have serious consequences. Depending on the violation and the zone, you may receive a fine, be banned from driving or have to pass mandatory reinstatement examinations. Grading in degrees
De Belgische wegcode deelt snelheidsovertredingen in vier graden in. Eerste graad: overschrijding tot 10 km/u. Tweede graad: 11 tot 20 km/u overschrijding. Derde graad: 21 tot 30 km/u. Vierde graad: meer dan 30 km/u. Vanaf de tweede graad is een rijverbod mogelijk.
Fines and opdeciemen
Fines in Belgian criminal law are multiplied by 8 (opdeciemen). A legal fine of 400 euros thus becomes 3,200 euros in practice. Added to this are court costs.
Driving ban for speeding
From the second degree on, the judge can impose a driving ban. At the fourth degree or repeatedly, a driving ban is almost certain. A driving ban of more than three months automatically leads to mandatory retests.
What can a lawyer do?
A lawyer can check the measurement, radar device and procedure for errors. Even if the facts are proven, a lawyer can argue for reduced penalties, suspension or a limited driving ban. Especially for drivers who need their licence for their profession, this is essential.
