Driving under the influence of drugs: consequences and punishment in Belgium

Driving under the influence of drugs is a serious traffic and criminal offence in Belgium. The consequences are more severe than many drivers realize: immediate revocation of a driving licence, heavy fines, a criminal record and even imprisonment are possible. What drugs are punishable behind the wheel?

Belgian law prohibits driving under the influence of a range of illegal and certain legal substances. The law distinguishes two categories:

  • Illegal drugs for which a positive saliva test is sufficient: cannabis (THC), cocaïne, amfetamine, methyleendioxymethamfetamine (MDMA/XTC) , morfine (waaronder de heroïne-metaboliet 6-acetylmorfine) en, sinds de wetswijziging van 2026, ketamine. De lijst is limitatief: stoffen die er niet in voorkomen, vallen niet onder artikel 37bis. Bij ketamine hoort wel een praktische kanttekening: de speekseltesten waarover de politie vandaag beschikt, sporen die stof nog niet op, zodat de vaststelling voorlopig via de speekselanalyse in het labo verloopt. Een positieve speekseltest is al voldoende voor een onmiddellijke rijbewijs-intrekking.
  • Medications that impair driving ability: certain sleep and sedatives, antidepressants or painkillers may also be grounds for prosecution if you are unable to drive safely.

The saliva test and blood analysis

Bij een verkeerscontrole kan de politie een speekseltest afnemen. Is de speekseltest positief, dan wordt u verplicht mee naar het politiebureau voor een bloedanalyse. De bloedanalyse is bepalend voor de vervolging: een positieve bloedtest is het bewijs dat u vervolgd wordt.

Note that you can refuse the saliva test, but this is considered equivalent to a positive result and leads to the same consequences. Refusal of the blood draw is also punishable.

Immediate revocation of driving licence

Bij een positieve speekseltest kan de politie uw rijbewijs onmiddellijk intrekken voor maximaal 15 dagen. Daarna beslist de procureur of het rijverbod wordt verlengd of opgeheven. In ernstige gevallen (herhaling, ongeluk met gewonden) kan de onmiddellijke intrekking worden verlengd tot 3 maanden.

Penalties for driving under the influence of drugs

Upon conviction by the police court, you risk:

  • Fine: minimum €1,600 (after multiplying by the opdeciemen ×8)
  • Driving ban: minimum 8 days, can rise to years for repeat or serious offences
  • Imprisonment: een eerste feit wordt niet met een gevangenisstraf bestraft, want artikel 37bis, § 1 voorziet uitsluitend een geldboete. Bij herhaling binnen drie jaar bedraagt de gevangenisstraf één maand tot twee jaar (artikel 37bis, § 2), en bij een nieuwe herhaling binnen drie jaar na de tweede veroordeling kunnen die gevangenisstraf en die geldboete worden verdubbeld.
  • Reinstatement examinations: medical and/or psychological examination, theory and practical examination before you get your licence back
  • Alcohol interlock: imposed in certain cases as an alternative punishment (not standard with drugs)

Combination drugs and alcohol: aggravation

If you simultaneously test positive for drugs and have an alcohol level above the legal limit, penalties are increased. This is considered an aggravating circumstance and results in higher fines and longer driving bans.

Repetition: dire consequences

For a second offence within three years, the penalties are doubled. For a third offence, the police court can permanently revoke the driving licence. This is not a temporary driving ban but a permanent loss of the right to drive.
