Many people confuse the terms “traffic court” and “police court.” In Belgium, there is no separate traffic court - it is the police court that has jurisdiction over most traffic cases. Novex Lawyers clarifies.
Police court as traffic judge
The police court is the competent court for traffic offenses in Belgium. It handles all road traffic law violations, from speed to alcohol, drugs, hit-and-run and driving without a license.
When does a traffic case NOT go to police court?
For serious offenses - such as traffic accidents involving deaths or serious injuries, or cumulative crimes - the case goes to the correctional court. This is a higher criminal court with harsher penalties.
