Police court as traffic judge
The police court is the competent court for traffic offences in Belgium. It handles all road traffic law violations, from speed to alcohol, drugs, hit-and-run and driving without a licence.
When does a traffic case NOT go to police court?
Fatal road traffic accidents, and failure to stop after an accident causing injury or death, also remain within the jurisdiction of the police court (Articles 138, 6° and 6°bis of the Judicial Code). A case is referred to the correctional court only where a road traffic offence is connected with an offence that is not a road traffic offence.
