Divorce by mutual consent (EOT).

In an EOT, both spouses agree on the divorce and the consequences: division of property, residence of the children, maintenance contributions. The agreement is recorded in a notarized or private agreement submitted to the family court. This procedure is faster and cheaper than a contested divorce.

Divorce on grounds of irreparable dislocation

When spouses disagree, one of them can file for divorce based on irretrievable breakdown of the marriage. The judge determines that the marriage has been permanently disrupted. All points of contention (children, property, alimony) are settled by the court if the parties cannot work things out on their own.
