When do estate conflicts arise?
Inheritance disputes can arise when heirs disagree on the distribution of the estate, when a will is contested for incapacity or influence, or when an heir believes his or her reserved portion has been violated by gifts during the decedent's lifetime.
Contestation of a will
A will can be challenged if the testator was not competent to make a valid expression of will, if the will does not meet the legal requirements of form, or if the testator was influenced by third parties (lack of capacity or defects of consent).
Reduction of gifts
When a deceased person has given too much during his life to the detriment of the legal heirs (forced heirs), those heirs can bring a claim for reduction. The reserved portion of children is protected by law.
