Workplace harassment in Belgium: filing complaint and legal action
Workplace harassment is prohibited in Belgium by the Welfare Law. If you face repeated harassing behavior by a colleague, supervisor or employer, you have the right to file a complaint and take legal action.
What is harassment at work?
Workplace harassment is unlawful conduct that occurs repeatedly and has the purpose or effect of affecting the employee's personality, dignity or psychological or physical integrity. Examples include: verbal aggression, social isolation, ridicule, spreading gossip or excessive control.
The procedure: internal and external complaint
In the first instance, turn to the confidential advisor or the psychosocial aspects prevention advisor within your company. If that internal route does not work, you can file a formal complaint with the prevention advisor or file a complaint with the Workplace Welfare Inspectorate.
