Driving under the influence of alcohol is one of the most common offenses before the police court in Belgium. The consequences can be far-reaching: a driving ban, a fine multiplied by 8, mandatory remedial exams and, in serious cases, imprisonment.
Alcohol limit and measurement
In Belgium, the legal alcohol limit is 0.5 promille (0.22 mg/l of breath). A stricter limit of 0.2 promille applies to novice drivers and professional drivers. The measurement is done via a breath analysis device or a blood test.
Possible penalties for alcohol intoxication
The court can impose: a driving ban (minimum 8 days, maximum several years), a fine of minimum 1,600 euros x 8 opcents, mandatory remedial exams (theoretical and/or practical exam, medical or psychological examination in case of CARA), and in serious cases or in case of recidivism, a prison sentence.
The alcohol lock as an alternative
For an alcohol level of 1.2 promille or more, the judge may impose driving with an alcohol lock as an alternative to a longer driving ban. This allows you to drive faster but only with a vehicle equipped with an alcohol lock.
