VAT debts in Belgium: payment plan, objection and personal liability

VAT debts are one of the most common causes of financial difficulties for the self-employed and companies in Belgium. The VAT administration has strong recovery powers and can move quickly to coercive measures. In this article, Novex Advocaten explains what you can do in case of VAT arrears, what payment plans are possible and when legal assistance is necessary.

How do VAT debts arise?

VAT debts arise when the VAT you have collected from your customers is not passed on (on time) to the State. This may be due to cash flow problems, accounting errors, late submission of VAT returns or fraud. VAT administration has high penalties and negligence interest on overdue amounts.

Coercive measures of VAT administration

If you do not pay your VAT debts, the VAT administration has far-reaching powers:

  • Writ of execution (dwangbevel): an enforceable title that permits immediate attachment without prior judgment;
  • Seizure of bank accounts: the bailiff can block your accounts;
  • Seizure of movable and immovable property;
  • Tax debt in bankruptcy: VAT debts are preferential claims that are paid before ordinary creditors.

Requesting payment plan from VAT administration

De BTW-administratie staat in principe open voor het sluiten van een afbetalingsplan, op voorwaarde dat u aantoont dat u te goeder trouw bent en een realistisch plan kan voorleggen. Een betalingsplan schort de dwangmaatregelen tijdelijk op. Het is essentieel om snel te reageren: hoe langer u wacht, hoe moeilijker het wordt om een akkoord te bereiken. Een advocaat kan de onderhandelingen voeren en een geloofwaardig plan opstellen.

Objecting to a VAT assessment

Indien u het niet eens bent met een BTW-aanslag (bv. na een BTW-controle), kunt u bezwaar indienen bij de directeur van de BTW. De bezwaartermijn bedraagt in principe drie maanden na de datum van de aanslag. Wordt het bezwaar afgewezen, dan kunt u verdere stappen ondernemen voor de rechtbank van eerste aanleg.

Personal liability of directors

A director of a company may be held personally liable for unpaid VAT debts in cases of apparent gross misconduct that contributed to the bankruptcy, or for repeated late filing of VAT returns. This is a significant risk that directors should take seriously.

NSSO debts: same risks

Naast BTW-schulden vormen ook RSZ-schulden (niet-betaalde sociale bijdragen) een groot risico voor ondernemers. De RSZ heeft vergelijkbare invorderingsbevoegdheden en bestuurders kunnen persoonlijk aansprakelijk worden gesteld. In geval van faillissement zijn RSZ-schulden superprivilegiehouders.
