Your rights during a police traffic stop

During a police check in traffic, you have both rights and obligations. Novex Lawyers explains what the police may demand and what you can refuse - and what the consequences of refusal are.

What are police allowed to do during a traffic stop?

The police may ask you to show your identification card, driver's license and registration certificate. They may take a breath test, check your vehicle for technical condition, and if suspected, take a saliva test for drugs.

Can you refuse the breath test?

No - refusal of the breath test is punishable and equated to intoxication. Thus, the penalties are as severe as a positive test. Refusal is almost never in your favor.
